Terms of Service

These terms are an agreement between you and yeskite ("yeskite", "we", "us"). By creating an account or connecting another service to yeskite, you agree to them. If you use yeskite for a business, you agree on its behalf and confirm you're allowed to. Our Privacy Policy explains how we handle personal information.

The service

yeskite lets you build opt-in funnels that qualify leads with your questions, offer qualified leads a call on your calendar, and send everyone else to another offer. It can connect to Zoom, Google Calendar, Gmail, Telnyx, and email providers for meetings, calendar events, emails, and text reminders.

Your account

• You must be at least 18 and able to enter into a contract.
• Give accurate sign-up details and keep them current.
• Keep your password safe. You're responsible for what happens in your account. Tell us straight away at passbyappsupport@gmail.com if you think someone else has used it.
• Each workspace is for one person. Don't share a login.

Price

yeskite is free during early access, and we won't charge you for it. If we add paid plans, we'll tell you at least 30 days before, and we'll only charge you if you choose a paid plan. Services you connect, such as Zoom, Telnyx, or an email provider, bill your own account under their own terms.

Your content and your leads

You own what you put into yeskite, including your funnels, files, and lead list. You give us permission to store, copy, display, and process it only as needed to run the service for you, and you can take it back by deleting it or your account.

You're responsible for how you collect and contact leads. In particular, you agree to:

• tell leads who you are and how you'll use their information, and have a lawful basis for collecting it,
• follow the laws that apply to your emails and texts, such as CAN-SPAM, the TCPA, and GDPR, and honor opt-out requests,
• not use qualifying questions to collect payment card numbers, passwords, government ID numbers, or health information, and
• respond to leads who ask to see or delete their information.

For lead data, you decide what's collected and why, and we process it on your behalf as our Privacy Policy describes.

Connected services

When you connect Zoom, Google, Telnyx, or an email provider, you authorize yeskite to act on that account only as described in our Privacy Policy and the guides for Zoom and Google. Your use of those services is governed by their own terms. We don't control them and aren't responsible when they're unavailable or change how they work. You can disconnect any of them at any time. Leads can only book calls while Zoom is connected, because each call gets its own Zoom meeting.

Acceptable use

Don't use yeskite to:

• break any law, or help someone else break one,
• send spam, or contact people who haven't agreed to hear from you,
• make false or misleading offers, or impersonate anyone,
• publish content that's hateful, harassing, sexually explicit, or that infringes someone else's rights,
• upload malware, or files you don't have the right to share,
• try to reach another workspace's data, probe or break our security, or overload the service, or
• copy, resell, or scrape the service.

Early access and changes

yeskite is in early access. Features may change, and some integrations are still being tested against the real services. We'll try to give notice before removing a feature you rely on, but we don't promise any level of availability.

Ending your use

You can stop using yeskite at any time, and ask us to delete your account by emailing passbyappsupport@gmail.com. We may suspend or close an account that breaks these terms, puts other users or the service at risk, or that the law requires us to close. Where it's reasonable, we'll tell you first and give you time to save a copy of your leads.

Disclaimers

yeskite is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't promise that the service will be uninterrupted or error-free, or that every email, text, calendar event, or meeting will be created or delivered on time.

Limitation of liability

To the extent the law allows, yeskite won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, leads, sales, or data. Our total liability for any claim about the service is limited to the greater of what you paid us in the 12 months before the claim and US$100. Nothing in these terms limits liability that can't be limited by law.

Indemnity

You'll defend and compensate yeskite against claims arising from your content, your funnels and offers, how you contact your leads, or your breach of these terms.

Changes to these terms

When these terms change, we'll update the date at the top, and we'll email you about significant changes before they take effect. If you keep using yeskite after that, the new terms apply. If you don't agree, stop using it and ask us to delete your account.

General

If a part of these terms can't be enforced, the rest still applies. Not enforcing a part straight away doesn't mean we give it up. These terms and the Privacy Policy are the whole agreement between you and yeskite about the service.
